Section 1 – Event dates

1.1 Event and route description
A route is available for participants in the Race Across The Alps, which begins in A-6543 Nauders and ends in A-6543 Nauders. The basis is the road book that every rider receives.
 
1.2 Time, place and type of event
Event date: 23.06. / 24.06.2023
Start time: 13:00 on 23.06.2023
Start and finish location: A-6543 Nauders
The event type is a cycle tourism event. There are no roadblocks, rather the participants have to comply with the respective road regulations (A: Austrian road traffic regulations StVO 1960; CH: Swiss Road Traffic Act SVG 1958; IT: Codice della Strada), the participants must inform themselves about the content of this before the start of the event.

1.3 Organiser
The organiser of the Race Across The Alps is the Bike Club Nauders (ZVR 286418584) with registered office in A-6543 Nauders, Kreuzgasse 94.

Section 2 – Conditions of participation and rules of conduct

2.1 Registration / Obligation to provide complete and correct personal data
Registration for the Race Across The Alps takes place online using a corresponding form. There is a link on the raceacrossthealps.com website which, when activated, will take you to the ticketing partner (https://ntry.at) where you can register.
The tickets for participation in the Race Across The Alps are personal, a transfer to third parties is therefore excluded. Registrations from persons who belong to a national or international association and are currently banned for doping will not be accepted.
 
2.2 Age restrictions
Anyone who is at least 18 years of age or older on the day of the race is entitled to start. The organiser reserves the right to request proof of age and official identification from each participant.
 
2.3 Doping restrictions / Ban on alcohol and drugs
Participants are prohibited from using any performance-enhancing substances during the event. In particular, the use of substances and processes that are prohibited by national regulations or the guidelines of the World Athletics Federation, WADA, NADA or the UCI is prohibited.
The organiser reserves the right to ensure compliance with the doping rules and to exclude participants from the cycling event if violations are detected. In this context, the participants declare their willingness to carry out the necessary verification procedures, including the associated interventions in physical integrity, by registering for the event; if such a verification procedure is refused by a participant, the participant will automatically be excluded from the event and will be disqualified.
According to the SMG, alcohol and drugs also count as performance-enhancing substances.
 
2.4 Physical requirements for participants
Only people whose bikes comply with the provisions of the road traffic regulations of Austria, Italy and Switzerland are allowed to take part in the cycling marathon. In addition, the participants are prohibited from using technical aids to increase their performance – in whatever form. The organiser reserves the right to exclude participants from participating in the Race Across The Alps if violations are identified.
All participants are obliged to wear a crash helmet for the entire route.
 
2.5 Technical requirements for participants
Only people whose bikes comply with the provisions of the road traffic regulations of Austria, Italy and Switzerland are allowed to take part in the cycling marathon. The organiser reserves the right to exclude participants from participating in the Race Across The Alps if violations are identified.

2.6 Other information on medical and technical matters
The organiser does not guarantee comprehensive medical care (point 2.4)
If health problems occur, the participant must immediately stop participating in the Race Across The Alps Nauders and seek help as soon as possible, for example by making signals asking the occupants of passing vehicles for help. At no point on the route will there be stationary medical care from the organiser.
 
2.7 Cancellation of registration / Transfer of the ticket to a third party
If a person has registered for the Race Across The Alps Nauders, they are bound to their registration. Cancellation of the registration is normally not possible. The transfer of the ticket to a following year may be possible after examining the circumstances.

Pandemic:  If the event is cancelled due to the ongoing corona pandemic, the entry fee already paid, minus €20 fee (NTRY ticketing), will be paid out or, if desired, carried forward to the following year.
 
2.8 Authority to issue instructions 
The orders of executive bodies, officials, volunteers and marshals of the organiser must be followed. Failure to comply with such obligations will result in participants being disqualified and excluded from the race. If violations of the Road traffic regulations (StVO) are observed, the personal data of the participants will also be forwarded to the responsible authorities for security reasons.
 
2.9 Other rules of conduct
The participants undertake to treat each other and the organiser’s staff with respect and to treat the organiser’s facilities and systems with care.
 
2.10 Exclusion during the event
If a participant violates the conditions of participation or the respective road law standards during the event, the organiser will prohibit him/her from continuing the journey.

It is expressly pointed out that the event will be held with the assistance of security officers from the respective host countries, who have the authority to exclude participants from the event at any time due to violations observed of the conditions of participation or road traffic regulations – such as driving in the left lane or disregarding priority or traffic light regulations.
 
2.11 Advertising
Any active and passive advertising by the participants is prohibited without the written consent of the organiser. This applies in particular to the erection of advertising stands and the like along the route.
Manipulation of the advertising measures planned by the organiser (e.g. logo imprints on start numbers, advertising banners, etc.) are also prohibited.
 
2.12 Changes to the terms and conditions of participation
The organiser reserves the right to change the conditions of participation and these rules at any time. Such changes will be available at www.raceacrossthealps.com.

Section 3 – Liability

3.1 Applicable law
Austrian law applies exclusively to the contract concluded between the participant in the Race Across The Alps Nauders and the organiser and to all associated rights and obligations, to the exclusion of all reference standards.
The place of jurisdiction for any legal disputes arising from the organiser contract is agreed to be the factually and locally competent court for A-6543 Nauders.
 
3.2 Participation at your own risk / Disclaimer
The participants in the Race Across The Alps Nauders acknowledge that the event is a cycle tourism event on an open route, so that collisions with motor vehicles, other participants or spectators or persons of the organiser are possible at any time. The participants acknowledge that due to the lack of barriers, grazing animals as well as loose dogs, chickens or wild animals can cross the road at any time and place along the route, which are beyond the control of the organiser.
Participation in the cycling marathon is at your own risk. The organiser assumes no liability for accidents or other property damage or personal injury before, during or after the event, including those caused to or by third parties, unless the organiser can be blamed for intent or gross negligence.
Liability of the organiser for damage to property is completely excluded.
 
3.3 Information obligation of the participants
The participants are obliged to take part in the information event held by the organiser. The time and place of this event will be published promptly on the website of the organiser.
 
3.4 Change / Cancellation / Cancellation of the event
The organiser reserves the right to shorten the route in the event of bad weather, unforeseen events or official orders, to change the time limit for individual parts of the route or the entire route or to cancel the event in whole or in part in the event of imminent danger to the participants.
In these cases of subsequent impossibility of performance, no refund of the registration fee will be made. It is also usually not possible to transfer the tickets to the following year (the circumstances will be checked).
 
3.5 Disclaimer for website content
The organiser does not guarantee that the data published on the website about the event and other information on dates, locations, prices or business partners are correct and complete. No legal claim can be derived from any errors found there.

Section 4 – Privacy policy

4.1 Non-sensitive data
We process all non-sensitive personal data, in particular name, age, gender and address, which we collect from you as part of the event contract, exclusively to carry out the “Race Across The Alps Nauders” event and to publish the results on the website.
We only forward these data to processors and third parties for these purposes, which we separately oblige to comply with data protection regulations. The data processing takes place on the basis of Article 6 para. 1 lit b GDPR and is therefore lawful. The data are stored for a period of 3 years, in individual cases – for example to defend against any claims for damages – also for a period of 30 years.
We keep your data with the utmost care and only store them for as long as we are legally obliged to do so or as long as this is necessary to safeguard legal claims. Regarding your personal data, you have the right to information, correction and, after termination of the contractual relationship within the legal framework, the right to deletion, restriction of processing or objection to processing and data portability with the controller Bike Club Nauders (ZVR 286418584) as well as the right of complaint with the data protection authority.
 
4.3 Correspondence via email
The participant is aware that when communicating via email without encryption, the confidentiality of the information sent cannot be guaranteed. By registering for the event, however, the participant expressly agrees to communication via unencrypted emails – in particular for sending the start number and other event information – and accepts that this takes place without the organiser being liable for the confidentiality of the message sent. This consent may be revoked at any time
